County Commissioners Immune from Liability for Motorcyclist’s Injuries Caused by Raised Pavement Edge in Colorado Work Zone
Abstract:This is a decision made in the Court of Appeals of Colorado, Division Two on February 22, 1996. Plaintiff, Michael Charles Click, was riding on an Alamosa County road and struck the edge of the newly laid asphalt resulting in serious injuries. Plaintiff filed suit against the Colorado Department of Transportation (DOT) and the Board. Both the DOT and the Board moved to dismiss the complaint.
