Ohio Jury Finds Contractor Negligent for Failure to Replace Guardrail as Soon as Practical

Abstract:

In Cleveland, Ohio a jury determined that a contractor was negligent for failing to replace a guardrail “as soon as practical” as required by the contract with the Ohio Department of Transportation. The finding in this case reemphasizes the fact that it is vital to set standards and write contracts that are unambiguous, to say what is intended under normal conditions, and provide guidelines for action when the circumstances are abnormal. Facts about the accident and trial are included.
