OSHA Finalizes Updated Worker Walkaround Rule

Abstract:

During OSHA workplace safety inspections, employees have the right to choose a representative to accompany the inspector, as outlined by the OSH Act. In August 2023, the Department of Labor proposed changes to clarify who could serve as worker representatives, finalized in March 2024, effective May 31, 2024. Key updates include allowing workers to select a third-party, non-employee representative with relevant safety knowledge or communication skills, subject to OSHA inspector approval. This rule aims to empower workers, enhance safety, and maintain a balanced approach in the inspection process. Additional guidance and FAQs are available for further clarification.
